1. DEFINITIONS
    1. “Bank” refers to EastWest.
    2. “Card” refers to the EastWest EveryDay Titanium Mastercard issued by the Bank pursuant to the license by Mastercard International.
    3. “Cardholders” refer to persons to whom the Card was issued.
    4. “Cash Rebate Program Feature” or “Program” refers to the loyalty program extended to the Cardholders.
    5. “Cash Rebate Terms” refer to these Cash Rebate Program Terms and Conditions.
    6. “Eligible Transaction” means any retail, non-installment transaction successfully charged to the Card; provided the same is/are not excluded under the Clause 3.d of the Cash Rebate Terms.
    7. “Cash Rebates” mean the Philippine Peso value earned by Cardholders from Eligible Transactions on their Card, subject to the Cash Rebate Terms herein.
    8. “Essential Purchases” means purchases from supermarkets, drugstores or gasoline stations according to the Transaction Code classification set solely by the Bank.
    9. “Non-Essential Purchases” means purchases that are not made from supermarkets, drugstores or gasoline stations according to the Transaction Code classification set solely by the Bank. Reference also under Clause 3.d of the Cash Rebate Terms.
    10. “Account” means the Cardholder’s Card account with the Bank.
    11. “Cut-Off Date” means the day that the electronic Statement of Account or billing statement for an Account is generated.
    12. “Cycle Month” means the period beginning on the cut-off date to the day before the next cut-off date of the Account.
    13. “Good Standing” means accounts that are not delinquent, not under investigation due to suspected fraudulent activities, not reported lost or stolen and those who have not, otherwise, violated any of the Terms and Conditions Governing the Issuance and Use of EastWest Credit Cards.
  2. ELIGIBILITY AND PARTICIPATION
    1. The Program is open to all Cardholders in good standing, at the time of rebate crediting and as defined herein unless otherwise determined by the Bank.
    2. If a Cardholder's Card is terminated at any time and/or for any reason, whether by the Cardholder or the Bank, the Cardholder will forthwith be disqualified from earning Cash Rebates and all Cash Rebates then accrued shall automatically be forfeited immediately after the voluntary or involuntary cancellation of the Card.
    3. Transfer of Cash Rebates from an expired or closed Card account to another current Card account will not be allowed.
    4. Cardholders whose accounts have reached sixty (60) days past due then later on availed of any collection program or offer shall have their Cash Rebates forfeited despite eventual payment of their account.
    5. All questions or disputes regarding eligibility to earn, accumulate or redeem Cash Rebates or otherwise participate in the Program shall be resolved by the Bank at its sole discretion.
    6. The Bank is entitled, at any time, in its absolute discretion, and without needing to give any reason and/or notice, to terminate the Card or cancel and/or invalidate or reverse any Cash Rebate already granted.
  3. ISSUANCE AND CREDITING OF CASH REBATES
    1. A Cardholder will earn Cash Rebates from eligible local and/or international transactions.
    2. Percent of Cash Rebate that could be earned shall be based on a tiered scheme dependent on the spend amount on non-essential purchases per cycle month.
    3. Percentage of Cash Rebate shall be as follows:
      1. 5% Cash Rebate on supermarket, drugstore and/or gas purchases for a particular statement cycle, if the total amount on non-essential purchases is greater than or equal to Php10,000.
      2. 3% Cash Rebate on supermarket, drugstore and/or gas purchases for a particular statement cycle, if the total spend amount made on non-essential purchases is greater than or equal to Php5,000 and less than Php10,000.
      3. 0.5% Cash Rebate on supermarket, drugstore and/or gas purchases for a particular statement cycle, if the total spend amount made on non-essential purchases is less than Php5,000.

      Non-essential Purchase Amount Cash Rebate to be applied on essential purchases:
      Php10,000 and above 5%
      Php5,000 to below Php10,000 3%
      below Php5,000 0.5%

    4. Transactions not eligible for Cash Rebates computation and/or non-essential spend computation include, but are not limited to, purchases made at wholesale and warehouse club merchants, installment amortizations, cash installment loans, Quick Bills Auto-Charge, auto-charged insurance premiums, balance transfers, cash advances, Convert-to-Installment, refunded, disputed, unauthorized or fraudulent transactions, annual membership fees and other fees and charges. The Bank reserves the right to exclude the eligibility of transactions for Cash Rebates computation and/or non-essential spend computation. Cash Rebates shall be earned once the valid transaction has been posted to the Account and not on the date of transaction.
    5. Cash Rebates shall be computed on a per valid transaction basis, rounded down to the nearest peso, excluding decimal values.
    6. Cash Rebates shall be considered as a credit transaction to the Card account and are not to be considered as payment.
    7. The Program will have a monthly rebate cap of Php1,000 for every cycle month. If the monthly cap has been met anytime within the cycle, the Cardholder will only begin earning Cash Rebates again at the beginning of the next cycle.
    8. Cash Rebates for transactions earned for the current month shall be accrued into the Cardholder’s account on the next cycle and shall be reflected on the next cycle’s electronic Statement of Account. Crediting shall be done upon accumulation of Php200 equivalent amount in Cash Rebates. In the event that the Cash Rebate earned is less than Php200 for the particular month, the total Cash Rebate amount will be carried over to the next month. Cash Rebates below Php200 shall not qualify for redemption and crediting.
    9. The accumulation of Cash Rebates shall be indicated in the monthly electronic Statement of Account. Cash Rebates are not transferable to any other EastWest Credit Card account even if the account belongs to the same person.
    10. Unless the Bank hears from the Cardholder within thirty (30) days upon delivery of his/her monthly electronic Statement of Account to his/her billing address and/or e-mail address, the Cash Rebates for the Card account on the statement are considered correct and final.
    11. Transactions made by the supplementary cardholder shall form part of the principal Cardholder’s transactions and shall qualify under this Program.
    12. Once a Cardholder’s becomes thirty (30) days past due, Cardholder shall no longer be credited with Cash Rebates. Nevertheless, earned but uncredited Cash Rebates may be reinstated once a Cardholder updates payment on his/her Card account, provided that the said Account has not reached sixty (60) days past due.
    13. The Bank reserves the right to temporarily or permanently disqualify any Cardholder and/or Account from the Program and forfeit in favor of the Bank, any remaining Cash Rebate including Cash Rebates pending credit if:
      1. The Cardholder’s Account or other EastWest Credit Card Account is sixty (60) days past due.
      2. The Card is cancelled.
      3. The Card is converted to any other EastWest credit card. Cash Rebates shall not be converted to points, cash, and other forms of compensation.
      4. The Card account is declared as fraudulent, counterfeit.
      5. The Cardholder has violated any of the Cash Rebate Terms and/or any of the Terms and Conditions Governing the Issuance and Use of EastWest Credit Cards.
    14. The Bank will reverse earned Cash Rebates related to disputed/charged back transaction on the month that the disputed/charged back transaction has been resolved in favor of the Cardholder. The Cash Rebate reversal shall reflect the:
      1. Cash Rebates that were earned from the disputed transaction/s.
      2. Cash Rebates that were earned due to the level/tier of transactions at the statement cycle when the disputed transaction was originally posted.
    15. The Bank shall be entitled to debit such Cash Rebates even if such debiting causes the Card account to exceed its credit limit and incur charges.

  4. OTHER CONDITIONS
    1. All questions or disputes regarding eligibility for the Card or eligibility of Cash Rebates for redemption will be resolved by the Bank at its sole discretion.
    2. The Bank shall, at its sole discretion, have the right to vary, modify or amend the conditions of the Cash Rebate Program Feature such as, but not limited to the manner of calculation of the Cash Rebates, the setting of the applicable percentage of Cash Rebates, the Cash Rebate Feature, the inclusions and exclusion of merchant categories in the Cash Rebate Program Feature or the eligibility of transactions for the Cash Rebate Program Feature as stipulated in the Card’s materials, and such modifications and amendments shall be effective on such date or dates as determined solely by EastWest.
    3. Existing EastWest credit cardholders who voluntarily convert their existing EastWest credit card to an EastWest EveryDay Titanium Mastercard shall be immediately charged with the annual membership fee of the new EastWest EveryDay Titanium Mastercard and vice versa. This shall appy to both the principal and supplementary cards.
  5. GENERAL
    1. By signing on or using the Card, the Cardholder expressly agrees that the Bank’s determination of eligibility to and computation of Cardholder entitlement to Cash Rebates as final and binding and that the Cardholder consents to and agrees to fully abide by the Cash Rebate Terms.
    2. The Bank may amend or modify, from time to time, any of the Cash Rebate Terms upon reasonable notice to the Cardholder.
    3. The Cardholder agrees that the Terms and Conditions Governing the Issuance and Use of EastWest Credit Cards are hereby incorporated by reference and shall form an integral part of the Cash Rebate Terms.
